Terms & Conditions of Trade

The short version

The detail is below, but here is the plain-English summary of where our responsibility starts and stops. Nothing in this summary replaces the full terms that follow.

What we cover

• Detailing and drafting your structure from your plans or sketches, to NASH light gauge steel framing standards.
• Manufacturing your frames to the drawings you have signed off, using quality-controlled roll-forming.
• A clear, itemised quote before you commit, and written confirmation of any change to it.
• Getting your framing on the road — delivered by us where practical, or booked with a freight provider.
• Fixing our mistakes — if we manufacture something that does not match your signed-off plans, we put it right.

What we don’t cover

• Building consent. Our drawings are not a consent application. Your engineer or architect must review and submit them.
• Design or building advice. We are framing manufacturers — anything we say about your build is opinion, not professional advice.
• Errors in the plans you sign off. We build exactly what you approve, so please check it carefully.
• Installation. We do not erect frames, and we are not responsible for the workmanship of whoever does.
• Third-party carriers, trades and suppliers we refer you to or book on your behalf.
• Delays outside our control — freight disruption, machine breakdowns, weather or steel supply shortages.

Agreement & definitions

By requesting a quote, placing an order, paying a deposit or using this website, you agree to these Terms & Conditions of Trade and to our Privacy Policy. They set out the basis on which SmartFraming Ltd deals with you.

In these terms:

• “We”, “our” or “us” means SmartFraming Ltd.
• “You” or “your” means the customer, website user or visitor.
• “Goods” means the steel framing, kitsets, components and any other products we supply.
• “Services” means drafting, design, manufacturing, delivery and related work we carry out.

If any part of these terms is found to be unenforceable, the remaining terms continue to apply. We may update these terms from time to time; the version in force is the one published on this website at the time you place your order.

Pricing & estimates

• Quotes remain valid for 7 days from the date of issue unless we state otherwise in writing. Steel pricing moves, so an older quote may need to be re-issued.
• Because final steel quantities are only confirmed at the drafting stage, the price may be adjusted by up to 10% to reflect the actual steel required.
• Substantial changes you request after quoting will incur additional charges reflecting the extra materials and drafting time.
• Unless stated otherwise, prices are in New Zealand dollars and include GST where applicable.
• Freight, tolls and ferry costs are additional unless the quote says they are included.

Why we don't publish a public price list

Every project is quoted individually. We don’t publish a fixed price list because:

• Customisation. Most kits require individual modifications that affect cost.
• Commodity fluctuations. Steel prices move weekly, so a published figure would quickly become inaccurate.
• Freight variability. Delivery cost differs significantly by location — often by $600 or more between sites.

Obtaining an accurate quote

To give you an accurate quote we need your delivery location and design details. Submit our online enquiry or kitset quote form and attach sketches or plans where possible. Formal quotes are confirmed by email so there is a clear, written record for both of us.

Deposits, payments & refunds

• A deposit of $1,150 (incl. GST) per framing kit, or the amount stated for your project, is required before drafting or manufacturing begins.
• Once drafting or manufacturing has started, your deposit is non-refundable.
• If your circumstances change before any work has started, we will refund the deposit less a fair allowance for the time already spent with you.
• Full payment is required before production or dispatch — nothing leaves our factory until it is paid for.

Deposits and invoices are paid by direct credit to:

Please include your name or invoice number in the reference fields. If we haven’t invoiced you yet, we will issue a tax invoice or receipt as soon as your deposit lands.

Goods remain the property of SmartFraming Ltd until payment has been received in full, and we may recover them if payment is not made.

Sign-off before manufacturing

Nothing goes into production until you have approved the final plans in writing — by email, or by approving the drawings and price through the secure link we send you, which records your name and the time of approval. Verbal approval over the phone is not enough — we will always ask for it in writing so there is a record of exactly what was approved.

We manufacture to the plans you sign off. Please check them carefully — dimensions, openings, heights and orientation — because once steel has been rolled to an approved drawing, changes become a new order at your cost.

Freight & delivery

Flat-pack deliveries by a freight provider

Flat-pack shipments are delivered to the carrier’s depot unless your site can take large trucks and has suitable unloading equipment on hand. Where the carrier will not go to your property, collection or on-forwarding from the depot is arranged and paid for by you.

Tracking

Once your kit leaves our factory, tracking it is between you and the freight provider. Kits are typically delivered within three to ten working days of collection.

Delivery by SmartFraming

Where we deliver made-up panels ourselves, we check site access beforehand, but we rely on your description of the property. If our driver judges access or ground conditions unsafe on arrival, we will unload at the nearest safe point we can reach. Frames are laid flat for safety; if you want them stood up against an existing structure, securing them is your responsibility.

Safety on site

• Where we deliver, our crew unloads. For third-party carrier deliveries to a depot, unloading and on-forwarding are arranged by you.
• We will not unload while children or animals are near the truck or trailer.
• You must provide a clear, safe unloading area. Damage to vehicles or other property left near the drop-off point is your responsibility.

Third-party carriers

When a third-party carrier delivers your framing, their terms apply and their liability is usually limited under the Carriage of Goods Act. We are not responsible for damage to your framing or property caused during a third-party delivery. We can send you a copy of the carrier’s terms before dispatch on request.

Manufacturing & delivery delays

We work hard to manufacture and deliver on time, and we will keep you informed if a date moves. But machine breakdowns, steel supply issues, carrier disruption and weather do happen. We are not liable for any loss, cost or knock-on programme delay caused by your framing arriving later than expected.

Designs for council submission

From your plans or sketches, our detailers produce a workable set of drawings that our roll-forming machines can manufacture from. Those drawings are prepared to NASH (National Association of Steel-framed Housing) standards, but they are not a consent application and are not council-ready on their own.

You must engage a qualified engineer or architect to review our drawings and submit them with their own documentation. For a fee, we can also provide frame-kit reports to support a PS1 (Producer Statement – Design) application.

Advice disclaimer

We are framing manufacturers. Some of our team have building experience, but anything we tell you — on the phone, by email or in person — is general opinion only, not professional design, engineering or compliance advice.

It is your responsibility to confirm the rules for your build with your local council and your own professionals before you commit. We can’t be held responsible for a project that later runs into consent or compliance issues, or for the costs of resolving them.

Non-structural & one-off framing

We are sometimes asked for one-off items with no engineering behind them — a desk frame, a bar leaner, or lengths to span between two containers, for example. We are happy to make them, but they are supplied without any warranty or guarantee and must not be relied on structurally.

Goods or trailers left at our yard

We don’t mind holding your framing or trailer for a few days, but anything left in our yard is at your own risk. Our yard is gated and padlocked only, and we are not liable for theft of or damage to it. Please make sure your own insurance covers it while it is with us.

Errors & omissions

Errors and omissions excepted. Quantities, dimensions, specifications and pricing must be verified by the purchaser, builder, designer and consultants before construction begins.

We rarely get a price wrong, but where we do, we may correct it — and we try in good faith to keep the revision as close to the original as we can. You may then accept the revised price or cancel, subject to the deposit terms above where drafting has already begun.

Referrals & recommendations

We refer builders, suppliers and other trades in good faith, usually based on positive feedback from other customers. If you engage or buy from them, that arrangement is between you and them: we are not responsible for their workmanship, product faults, pricing or delays. Please do your own due diligence, as you would with any business.

Your plans & our drawings

You keep ownership of the plans and sketches you send us. The detailed drawings, models and framing layouts we produce remain our intellectual property and are supplied for use on your project only.

Where we design a custom kitset for you, we may use the drawings and 3D views for general marketing. Your name, address and personal details are never published — see our Privacy Policy.

Warranties & liability

Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 where they apply. Where you acquire goods or services for the purposes of a business, you agree that those Acts do not apply to the extent permitted by law.

To the fullest extent permitted by law, our liability arising out of the supply of goods or services is limited to, at our option, replacing or repairing the goods, resupplying the services, or refunding what you paid for them. We are not liable for indirect or consequential loss — including lost profit, holding costs, equipment hire or labour standing idle.

Use of this website

• We are not responsible for inaccuracies in website content, which is provided “as is”.
• Material on this website may not be reproduced without our permission.
• External links are provided for convenience; responsibility for their content rests with the operator of the linked site.

Governing law

These terms are governed by the laws of New Zealand, and any dispute is subject to the exclusive jurisdiction of the New Zealand courts.
